Access instructions

Access instructions for the Progress Sports Club

Badge present (active): If you already have an access medium (badge) and it has not been inactive for more than 11 months, your subscription will be automatically renewed within the next 2-3 business days.

Badge present (inactive): If your access medium (badge) has been inactive for more than 11 months, please send us a copy of your ID and the badge number by email to team@progress-shop.ch . We will reactivate your badge within the next 2-3 business days.

New customers without a badge: If you don't yet have an access medium (badge), please select the subscription that includes the badge for an additional charge of CHF 30.00. Your access medium will be delivered to you by mail within the next 3-5 business days and will be activated upon receipt of your ID copy (please send it by email to team@progress-shop.ch ) .

House rules

Progress Sports Club – “with each other. for each other.”

General:
By paying for the subscription, the customer expressly agrees to these house rules and the general terms and conditions of zemp management gmbh. Every visitor is obligated to behave respectfully towards other customers, staff, and the infrastructure at Progress Sports Club.

Access to the Progress Sports Club:
The badge (personal and non-transferable) grants access to the club. For liability and safety reasons, guests without their own badge, as well as bringing companions, are prohibited. Violations of this rule will result in a CHF 200.00 fine and revocation of the membership.

Opening hours:
The opening hours of the Progress Sports Club are as posted. The customer trains at their own risk, and Progress accepts no liability. For security reasons, the club is under video and audio surveillance. All recordings are stored in accordance with legal requirements.

Hygiene:

  • For hygiene reasons, a towel must be placed on the seating and lying areas of the devices.
  • After use, the equipment, especially the endurance equipment, must be cleaned of sweat residue.
  • Training bags are not allowed on the training area.
  • Appropriate sports clothing and shoes must be worn during training. Bare-chested training is not permitted.
  • Bringing children (babies) and animals is prohibited.
  • When using the solarium, the applicable recommendations and rules must be observed. After use, the solariums must be cleaned with the provided disinfectant.

Behave:

  • Equipment and weight benches must be used properly and left in the same condition as they were found.
  • Free weights, weights, handles, etc. must be returned to their designated place.
  • Liquid chalk, chalk, and chalk are prohibited in the entire fitness area. Competitive athletes are permitted to use them in the cross-training area, provided residues are thoroughly removed after use (surface, bars, weight plates). Failure to comply with this rule may result in the revocation of this tolerance. Remember: "together. for each other."
  • If you notice any damage to equipment, please inform the staff or send an email to team @ progress-shop.ch .
  • Please leave the light switches off during the day.
  • The customer is not authorized to open the roof windows independently.

Drinks and food:

  • Only drinks offered by Progress or sealed bidos/shakers are permitted.
  • Only the snack products offered by Progress may be consumed.
  • For hygiene and disposal reasons, bringing your own food and drinks is prohibited at the Progress Sports Club.

Parking:
The Progress-designated parking spaces, white visitor parking spaces, or designated Hornbach parking spaces (outside of office hours) are available to customers during their stay. Irrevocable parking may result in a complaint from the property owner. Progress assumes no liability for complaints or parking damage.

Ninja Park Usage Regulations

General: Ninja Warrior Park is specifically designed for the use of ninja courses. Staff instructions and safety instructions must be followed.

Safety instructions:

  • The ninja course may only be used with at least one person within shouting distance.
  • Adequate warm-up is necessary before training to avoid injuries.
  • The obstacle may only be used once the previous person has left the fall protection area and it is clear of objects.
  • Climbing over the obstacles is prohibited.
  • The obstacles may only be used by one person at a time.
  • No clothing with rivets, cords, ribbons, loops, belts, key chains or other sharp-edged accessories are permitted in the facility.
  • For your own safety, please remove piercings, earrings, necklaces, watches and bracelets.
  • Any health restrictions should be discussed with a doctor before your visit.
  • The operator’s safety instructions and house rules must be strictly followed.
  • Respectful interaction and mutual consideration are expressly desired.
  • If the equipment is damaged, please inform the staff or operators of the facility immediately.

Golf usage regulations

Access: Access to the golf simulator and putting green requires a valid course permit, handicap, or Swiss Golf Card. These must be presented either in the shop or sent by email to info@progress-shop.ch .

Rules and etiquette:

  • Food & Beverages: Bringing open drinks and food is not permitted. Only Progress food and beverages are permitted.
  • Equipment: Clean shoes and clean equipment are mandatory.
  • Balls: Only unmarked balls may be used. Markings or club logos will leave marks on the screen and are therefore not permitted.
  • Limitation of use: Use of the facility is limited to a maximum of 4 people at the same time.
  • Respectful treatment: Always treat the premises and furnishings with respect.
  • Cleanup: After use, the facility must be left in a tidy condition. The lights must be turned off.
  • Intermediate door: Please keep the intermediate door to the simulator closed at all times to secure the room.

Opening hours: The premises are available 24 hours a day and are exclusively for Progress customers .

booking

  • Duration: Bookings are made by the hour, starting on the hour.
  • Booking shortening: Due to the handover and check-in and check-out at the facility, the effective playing time may be shortened by up to 10 minutes.
  • Online booking: Bookings are made via the online system at www.progress-shop.ch .
  • Maximum use: To be fair to other users, we ask that you limit your stay to a maximum of 2 hours per day.

Operating instructions for the Golf Simulator

Turn on the light: Turn on the light by pressing the switch on the right side of the door entrance to the Golf Simulator.

Start the system: Press the power button on the front of the PC to start the system. The system will boot automatically.

Projector control: Pull out the bottom drawer to remove the projector control. Inside the TrackMan box, press the red button on the box to start the projector. The system may automatically calibrate on the PC.

PC input: Select the center area of ​​the screen with your mouse. Log in using the QR code in the top right corner or play as a guest.

Game Options: Select one of the available game options, such as playing on a golf course, driving range, or another available option.

End game:

  • Log out: Please log out to exit the game correctly.
  • Shut down PC: Press the power button in front of the PC to shut down the system.
  • Turning off the projector: Press the red button on the projector control panel twice to turn off the projector. Please remain in the box until the projector lights up red.
  • Turn off the lights: Don't forget to turn off the lights before leaving the room.

Care and cleanliness:

  • Responsibility: All facilities must be used with the utmost care.
  • Order and cleanliness: Each user is responsible for leaving the premises tidy and clean.
  • Damage: The person responsible for damage or contamination caused intentionally or negligently will be held liable and responsible for the repair or cleaning costs.

Terms and Conditions

GENERAL TERMS AND CONDITIONS OF BUSINESS

1. SCOPE, CHANGE TO GENERAL TERMS AND CONDITIONS, SUBSCRIPTION

1.1. Scope: These General Terms and Conditions (GTC) govern the legal relationship between zemp management gmbh and the customer.

1.2. Amendments to the Terms and Conditions: Special provisions apply to certain Progress services and products. The customer expressly acknowledges that the Terms and Conditions and other usage regulations (house rules, operating regulations, etc.), which constitute an integral part of the Terms and Conditions, are subject to change for justified reasons and that these changes will be communicated to the customer in an appropriate manner. The customer cannot derive any rights from any amendment to the Terms and Conditions. The current provisions are available at any time at the Progress Sports Club.

1.3. Progress Sports Club Subscription: The subscription is personal and non-transferable. Subscriptions purchased online are considered legally valid once zemp management gmbh has received payment. ID is required upon purchase of a subscription. An official or government-issued photo ID is accepted.

1.4. Subscription Scope of Services: zemp management gmbh grants the customer non-exclusive use of the club during opening hours for the agreed fee. Use is only permitted with a valid subscription (the subscription is considered valid when the access key is activated, see Section 5.1). This offer is subject to change at any time; however, no claim to reimbursement or subscription renewal can be derived.

1.5. Subscription additional services: Progress will charge separate fees for additional products or services.

1.6. Subscription age restriction: Customers under the age of 15 are required to provide parental consent.

2. ACCESS MEDIUM (badge)

2.1. Access authorization to the Progress Sports Club: After completing the membership, the customer receives an access key that grants access to the club. Without the access key, the member may be denied access and the use of additional services. Policy:No entry without the access key (badge)! (See section 2.4)

2.2. Initial issuance fee: A one-time, non-refundable fee of CHF 30.00 will be charged. Only one access medium may be purchased per customer.

2.3. Handling of the access medium: The customer is obligated to ensure the safekeeping of his access medium and, in the event of loss of the access medium, to immediately report the loss to the club and purchase a new one.

2.4. Non-transferability of membership rights: The subscription is personal and cannot be transferred under any circumstances. The customer undertakes to use the access medium provided to them only personally and not to transfer it to third parties. If the customer violates this requirement, i.e., knowingly and willingly provides the access medium to a third party for the purpose of granting access, the club may impose a penalty of CHF 200.00 for each violation, as well as revoke the subscription, without requiring proof of damage. The assertion of further rights arising from such a violation, in particular the assertion of further damages, remains unaffected. A prior warning is not required.

2.5. Loss of the access medium: For each reissue of the access medium that becomes necessary due to culpable loss or damage to the access medium by the customer, a new payment of CHF 30.00 is due.

2.6. Cashless payment using the access medium: The club is entitled to introduce cashless payment for all products and services. If the club makes use of this option, the offered products and additional services can only be used by the member without cash using the access medium.

3. SETUP, USE, OPERATING HOURS AND SETTINGS

3.1. House Rules: When using the club, the customer is subject to the house rules, which are considered an integral part of the Progress subscription. The house rules contain, in particular, regulations regarding the permissible use of the equipment and the club, and for safeguarding the rights of other customers. Staff are authorized to issue instructions in individual cases, provided this is necessary to maintain orderly operations, order and safety, or compliance with the house rules. Members must follow these instructions. In the event of serious or repeated violations of the house rules and/or the instructions of staff, zemp management gmbh is entitled to issue a ban from the premises, terminate the subscription with immediate effect, and confiscate or invalidate the access medium. The customer is not entitled to a refund of the paid subscription fee. In the event of a serious disruption to training operations by the customer, no prior warning is required. Customers and third parties are prohibited from offering goods or providing services, whether for a fee or free of charge, on the premises of Progress Sports Club without the express written authorization of zemp management gmbh.

3.2. Use of Lockers: Lockers are provided in the club. Progress Service GmbH assumes no responsibility for the security or care of items placed in the lockers. Lockers may only be used by customers while present at the club. The club is entitled to open and empty occupied lockers if they are also used outside of club hours. The club will retain any items removed or found in the club (hereinafter "Lost and Found") for one month. The club's liability for handling lost and found items is governed by Section 8.1 of these Terms and Conditions.

3.3. Operating Hours/Cessation: The training area and equipment are available to the customer daily for non-exclusive use during the operating hours specified for the respective area, with the exception of inspections, cleaning, renovations, refurbishment, etc. The locations, operating hours, and equipment of the facilities of zemp management gmbh, as well as additional services, are subject to change at any time. The temporary or permanent closure or partial closure of one or more areas remains reserved at any time. A cessation of operations (e.g., due to inspections, maintenance or construction work, special events/occasions) does not entitle the customer to a refund of prepaid subscription fees or to an extension of the subscription period. A cessation of operations due to force majeure (e.g., fire, epidemics, pandemics, government restrictions, strikes) and/or the issuance of measures by government authorities also does not entitle the customer to a refund of prepaid subscription fees or to an extension of the subscription period.

3.4. Use of customer parking spaces: Customer parking spaces provided by the Club may only be used by the customer while at the Progress Sports Club.

4. CUSTOMER OBLIGATIONS

4.1. Accompanying Persons (Duty of Care): Bringing accompanying persons, including children (babies), is not permitted. Bringing animals is prohibited.

4.2. Violation of Code of Conduct: The customer is obligated to comply with the house rules and properly fulfill the code of conduct imposed on them by these Terms and Conditions. If the customer repeatedly violates their subscription obligations despite warnings, the club is entitled to terminate the subscription without refund.

4.3. Duty to Provide Information: The customer must immediately notify the club of any changes to contract-relevant data such as name, address, etc. Any costs incurred by Progress Sports Club due to failure to promptly notify the change in data shall be borne by the customer.

5. SUBSCRIPTION FEES, PAYMENT

5.1. Due Date: The total price is due in advance. The subscription fee is determined according to the current price list on our website. Without a received/processed payment and without an activated access key, access authorization is not granted. The access key will be processed and activated after receipt of payment. The customer must allow at least five "standard" shop business days for processing.

6. DURATION OF THE SUBSCRIPTION, RENEWAL, DECOMMISSION

6.1. Initial Term: The subscription has an initial term of 6, 12, or 24 months and ends automatically.

6.2. Subscription Renewal: A non-binding subscription reminder or renewal notice will be sent to the customer at least four weeks in advance. Without receipt of payment as per Section 5.1, the access medium will be automatically deactivated upon termination of the subscription.

6.3. Subscription Suspension: Subscription suspension periods and subscription renewal claims due to injury, sick leave, military service, vacation, non-use, relocation, etc. are not granted. Policy: The customer may not interrupt or pause the subscription, nor assert claims for subscription refunds, subscription renewals, or subscription transfers.

7. PROHIBITED SUBSTANCES IN THE CLUB

7.1. Prohibited Substances: Smoking, alcoholic beverages, or narcotics are prohibited in the club. Furthermore, customers are prohibited from bringing prescription drugs that are not for personal and medically prescribed use and/or other substances intended to enhance the customer's physical performance (e.g., anabolic steroids) into the club. Likewise, customers are prohibited from offering, procuring, transferring, or otherwise making such substances available to third parties in the club, whether for a fee or free of charge.

7.2. Consequences of a violation: If the customer violates the provisions of section 7.1, i.e., if he knowingly and willingly consumes prohibited substances in the club or passes them on to third parties, the club may demand a contractual penalty from him without requiring proof of damage.

8. LIABILITY

8.1. Limitation of Liability: The use of services provided by Progress Service GmbH, in particular the use of training facilities and equipment, is at the customer's own risk. Zemp Management GmbH excludes all liability for direct and indirect damages, to the extent permitted by law. The customer is responsible for taking out insurance. The customer is liable for willful damage to training facilities and infrastructure, as well as for the loss of rental equipment, and must fully reimburse Progress Service GmbH for the corresponding repair and/or replacement costs. Zemp Management GmbH assumes no liability for the loss or damage of clothing, valuables, or money brought along.

9. MONITORING

9.1. Camera Surveillance: The customer acknowledges and agrees that the entire Progress Sports Club (except sanitary facilities such as restrooms and changing rooms) will be monitored by cameras, including audio, for protection and security reasons.

10. DATA PROTECTION

10.1. Personal data: zemp management gmbh attaches great importance to the protection of your personal data. Since both the protection of your privacy and the protection of our customers are of particular importance to us, we will treat your personal data confidentially in compliance with applicable data protection regulations. We will neither publish your data nor share it with third parties; it will only be used to inform you about our activities and campaigns.

11. FINAL PROVISIONS

11.1. Invalidity of individual provisions: Should one or more provisions of this contract be or become invalid, this shall not affect the validity of the contract and its remaining provisions.

11.2. Participation in dispute resolution
For all disputes arising from this subscription, the place of jurisdiction shall be the respective registered office of zemp management gmbh.
